End User License Agreement

Thank you for choosing Pemi. This End User License Agreement ("Agreement") governs your use of Pemi, including any updates or modifications to the application. By downloading or using Pemi, you agree to the terms of this Agreement.

1. License Grant

Subject to the terms and conditions of this Agreement, Pemi grants you a limited, non-exclusive, non-transferable, revocable license to use Pemi for your personal, non-commercial use on a single mobile device that you own or control. You may not use Pemi for any other purpose.

2. Ownership and Intellectual Property

Pemi is owned by Pemi and is protected by copyright laws and other intellectual property laws. You acknowledge and agree that Pemi and all intellectual property rights therein are the exclusive property of Pemi. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of Pemi without Pemi's prior written consent.

3. User Content

Pemi allows you to create a company profile, but please note that creating a company on Pemi does not legally create a company, and we are not responsible for any legal or financial consequences that may arise. You are solely responsible for any content you upload or share on Pemi, and you represent and warrant that you have all necessary rights to do so.

4. User Conduct

You agree not to use Pemi for any unlawful purpose or in any way that violates this Agreement or any applicable laws or regulations. You also agree not to:

• Use Pemi in any way that could damage, disable, overburden, or impair Pemi or interfere with anyone else's use of Pemi.
• Collect or store any personal information of other users of Pemi without their consent.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.

5. Location Data

Pemi uses your location data solely for advertising purposes. By using Pemi, you consent to the collection and use of your location data for this purpose.

6. Disclaimer of Warranties

Pemi is provided "as is" without any warranties of any kind, whether express or implied. Pemi does not warrant that Pemi will be uninterrupted or error-free, nor does Pemi make any warranty as to the accuracy or reliability of any information obtained through Pemi.

7. Limitation of Liability

To the extent permitted by law, Pemi will not be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Pemi, even if Pemi has been advised of the possibility of such damages.

8. Termination

Pemi may terminate this Agreement at any time without notice if you breach any of the terms and conditions of this Agreement. Upon termination, you must immediately stop using Pemi.

9. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the United States. Any dispute arising out of or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of the United States.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and Pemi regarding your use of Pemi and supersedes all prior agreements and understandings, whether written or oral.

Pemi is committed to providing a safe and positive user experience for all users. This Acceptable Use Policy ("AUP") sets out the rules and guidelines for using Pemi. By using Pemi, you agree to comply with this AUP.

You may not upload or share any content on Pemi that is illegal, harmful, or offensive, including but not limited to:

• Content that is defamatory, obscene, or pornographic.
• Content that promotes or incites violence or hatred against any individual or group.
• Content that infringes the intellectual property rights of any person or entity.
• Content that contains viruses, malware, or any other harmful software or code.
• Activities that attempt to bypass or compromise the security or integrity of Pemi.

5. Reporting Violations

If you become aware of any violation of this AUP, please report it to Pemi immediately by contacting us at [insert contact information]. Pemi reserves the right to take any action it deems appropriate in response to any violation of this AUP, including but not limited to suspending or terminating your access to Pemi.

6. Changes to the AUP

Pemi reserves the right to amend or update this AUP at any time without notice. Any changes to the AUP will be posted on Pemi's website or in the app, and your continued use of Pemi after the changes have been posted will constitute your acceptance of the revised AUP.
